1. About these Terms
These Terms of Use ("Terms") govern your access to and use of Home Open Times ("HOT").
HOT is operated by Vumus Investments Pty Ltd (ABN 26 131 264 858), trading as Home Open Times ("Vumus", "HOT", "we", "us" or "our").
By creating an account, accessing HOT or using our services, you agree to these Terms and our Privacy Policy.
If you do not agree, you must not use HOT.
2. What HOT does
HOT is a technology platform that helps users discover, view, save and organise property inspections and enables authorised listers to publish and manage property and inspection information.
Unless expressly stated otherwise, Vumus Investments Pty Ltd:
- is not the vendor, landlord or owner of properties displayed on HOT;
- does not act as the real estate agent or property manager for properties merely because they appear on HOT;
- does not represent a buyer, tenant, vendor, landlord or listing agent in a property transaction;
- does not negotiate or enter property transactions on behalf of users; and
- is not responsible for the conduct of inspections or the ultimate sale, purchase, lease or management of a property.
Any property transaction is between the relevant parties and their respective agents or representatives.
3. Eligibility and accounts
You must be at least 18 years old to create an account.
You must provide accurate information and keep account information reasonably current.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account, except to the extent that activity results from something for which HOT is legally responsible.
You must notify us promptly if you believe your account has been accessed without authority.
We may require identity, agency, authority or licence verification where reasonably necessary to protect users or the integrity of HOT.
4. Property listings
You may only create or manage a listing if you are the property owner or have sufficient authority to advertise or provide the relevant property information.
Agents and other regulated property professionals are responsible for maintaining any licence, registration or authority required by applicable law.
A person supplying listing information must take reasonable care to ensure that information supplied to HOT is accurate and current, including:
- address;
- price or price information;
- photographs;
- property description;
- property features;
- inspection dates and times;
- contact details; and
- sale or rental status.
Listings may also be supplied or updated through authorised agency systems, CRMs, property management systems, APIs and other data feeds.
The party supplying the listing remains responsible for the accuracy and lawfulness of information it supplies.
5. Listing review
HOT may use automated and manual processes to review listings.
Review or publication by HOT does not mean that HOT has independently verified the ownership, condition, legality, accuracy, completeness, availability or characteristics of a property.
We may refuse, suspend, edit, restrict or remove a listing where we reasonably consider this necessary because:
- it may breach these Terms or applicable law;
- it may be inaccurate, misleading, fraudulent or unauthorised;
- it creates a security or safety risk;
- we receive a legitimate complaint or request concerning it; or
- removal is reasonably necessary to protect HOT, its users or a third party.
6. Inspection information
Inspection dates and times are supplied by listers or connected data sources and can change, be postponed or be cancelled.
Users should check the latest information and, where appropriate, confirm an inspection with the relevant lister before travelling.
HOT does not control the conduct of an inspection and cannot guarantee that an inspection will proceed at the advertised time.
7. Intellectual property and listing content
You retain ownership of content you own and upload to HOT.
By supplying content to HOT, you grant Vumus Investments Pty Ltd a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display and communicate that content to the extent reasonably necessary to:
- operate HOT;
- display and promote the relevant listing;
- provide HOT services; and
- promote HOT and properties available through HOT.
This licence continues for as long as reasonably necessary to provide the relevant service and manage legitimate archival, legal and backup requirements.
You warrant that you have the rights and permissions reasonably necessary to supply content you upload and to grant this licence.
The HOT platform, software, branding, design, databases and other material created or owned by us remain the property of Vumus Investments Pty Ltd or its licensors.
8. Acceptable use
You must not use HOT to:
- publish false, misleading, fraudulent, discriminatory, defamatory or unlawful material;
- impersonate another person or organisation;
- advertise property without appropriate authority;
- harass, threaten or abuse another person;
- send unsolicited spam;
- unlawfully collect or misuse personal information;
- scrape, harvest, systematically download, reproduce or commercially exploit HOT data without written permission;
- circumvent access controls or security measures;
- gain unauthorised access to accounts, systems or information;
- introduce malware or malicious code;
- interfere with HOT's operation; or
- use HOT for unlawful purposes.
Reasonable use of listing information by consumers for genuine property-search purposes is permitted.
9. Payments
Some HOT services may require payment.
Unless otherwise stated:
- prices are displayed in Australian dollars;
- GST is included where applicable; and
- payments may be processed by a third-party payment provider such as Stripe.
The price and inclusions applicable to a purchase will be displayed before payment.
Where a listing requires both approval and payment, publication may be conditional upon both requirements being satisfied.
Refunds and remedies are provided in accordance with the applicable package terms and the Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
10. Third-party services and data
HOT may integrate with or link to third-party services, including real estate agency systems, CRMs, mapping services, payment providers, websites and property portals.
We do not control independent third-party services and are not responsible for their availability, content or conduct.
Information obtained from authorised third-party systems may change without notice.
11. No guarantee of comprehensive coverage
HOT does not represent or guarantee that it contains every property, every listing or every open home or inspection available in a particular suburb, region or market.
Properties and inspection information displayed on HOT depend on listings and data made available to HOT by participating agents, agencies, owners, authorised listers and connected systems.
12. Suspension and termination
We may restrict, suspend or terminate an account or access to particular functionality where we reasonably believe this is necessary to:
- enforce these Terms;
- investigate suspected fraud, unlawful activity or misuse;
- protect HOT, its users or third parties;
- comply with law or a lawful request; or
- respond to a material security risk.
Where reasonably practicable and appropriate, we may give notice and an opportunity to remedy a breach before permanently terminating an account.
You may stop using HOT and delete your account at any time, subject to information we are legally permitted or required to retain.
13. Availability of HOT
We aim to provide a reliable service but do not guarantee that HOT will be continuously available or free from technical faults.
We may modify, maintain, update, suspend or discontinue functionality from time to time.
Nothing in this section limits rights that cannot lawfully be excluded.
14. Liability and Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right, guarantee, condition, warranty or remedy imposed by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or other applicable law where doing so would be unlawful.
Subject to those rights, HOT is not responsible for loss caused solely by inaccurate or outdated information supplied by an independent lister or third-party data provider where HOT has not caused or contributed to that inaccuracy.
To the maximum extent permitted by law, HOT is not liable for indirect or consequential loss arising from use of HOT.
Any limitation of liability in these Terms applies only to the extent permitted by law.
15. Changes to HOT and these Terms
We may update these Terms where reasonably necessary to reflect changes to:
- HOT or its functionality;
- our business operations;
- technology or security requirements; or
- applicable laws and regulations.
The latest version will be made available through HOT or our website.
Where a change materially affects users' rights or obligations, we will take reasonable steps to provide notice before or when the change takes effect.
16. Governing law
These Terms are governed by the laws of New South Wales, Australia.
The parties submit to the jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
